non-connectable advertising after gatt connection

I am running a gatt server and am trying to send non-connectable advertisement packets after I've made a gatt connection. I can send the packets but when reading them with a bluetooth sniffer I see that their type is actually ADV_IND. I reset the advertising data after stopping advertising and then I restart advertising with new params. Anyone now why the type won't change?
